Update on Commission Delegated Regulation (EU) 2024/197

Published on January 5, 2024, this regulation will apply from September 1, 2025, changing the classification of several substances listed in Part 3 of Annex VI to Regulation (EC) No 1272/2008 (CLP Regulation).
These changes will have an impact on the cosmetics industry, especially with regard to two substances potentially used in the formulation of cosmetic nail products:

N,N-dimethyl-p-toluidine

CE NO. 202-805-4

CAS NO. 99-97-8

INCI NAME: DIMETHYLTOLYLAMINE

Previously, this substance had no restrictions;

Its new classification as a category 1B CMR substance (Car. 1B) means that it is expected to be banned from September 1, 2025.

Diphenyl (2,4,6-trimethylbenzoyl)phosphine oxide

CE NO. 278-355-8

CAS NO. 75980-60-8

INCI NAME: TRIMETHYLBENZOYL DIPHENYLPHOSPHINE OXIDE

This substance already had restrictions on its updating, but the recent reclassification as a CMR substance, category 1B (Repr. 1B), means that its use can be expected to be banned from September 1, 2025, in accordance with Article 15 of Regulation (EC) 1223/2009 (Cosmetics Regulation).

Cosmetek is therefore warning its customers and partners to prepare in good time for this imminent change in cosmetics legislation.
